Restorative Justice: A Social Movement
Module 4: European Criminal Justice Policies on Victims and Restorative Justice

In this module we will look at the European model of restorative justice; their policies regarding victims and the use, and expansion of the use, of restorative processes. Restorative justice, while still not widely used, has experienced significant growth over the last several decades. Evaluations of restorative justice practices have shown (similar to the evaluations in the United States) positive outcomes with respect to recidivism rates and cost-effectiveness. Restorative justice advocates began promoting the expansion of the use of restorative justice practices and beginning in 1999, many initiatives were proposed regarding its use.

Next, we will review the victim and restorative justice policy developments in the European Union beginning with the Tampere Programme in 1999. This program was adopted by the European Union with the purpose of protecting victims while they are engaged in criminal proceedings related to a crime. Several directives will also be discussed that follow the Tampere Programme and we will explore how each address victims’ rights and compensation assistance.

Following the progression of directives, we will then look at the 2012 Victims Directive which was adopted to replace the earlier 2001 Directive discussed on page two. The purpose of the Victims Directive was to strengthen the rights of victims across the European Union and enhance the deficiencies noted from the 2001 Directive.

Finally, we will discuss the benefits of restorative justice to victims of crime. These pages will reiterate the benefits identified from literature, as well those benefits identified by victims that have been part of the restorative justice process.

Welcome to week four! In this module, we will continue our exploration of restorative justice practice but will focus primarily on European criminal justice policies.

Remember that you should cite to the course materials/readings or other outside research in the initial post (at a minimum but certainly in any follow-up comments as well). Engage with the assigned and recommended readings.
You are assigned a Critical Thinking Assignment this week. Pick one option from the two assignments to be submitted by Sunday at midnight. Please keep in mind when you are writing the paper to address all the prompts provided in the assignment. Also, you should cite two peer-reviewed articles to support your position on the topic you choose. If you are unfamiliar with APA citation format, please take a few moments to review it as this is a requirement for the assignment and does factor in to your overall grade for the paper. The paper should be three to four pages in length, not including cover page and bibliography.
